Legal update

We believe in keeping you ahead of your competitors

In business today keeping ahead of the competition often depends on the exploitation of information. Changes in the law can have a significant impact on the way a business operates. We provide regular Legal Updates and articles on key issues, a selection of which are available on this site.

Please note that these Legal Updates are for general guidance. Please get in touch with us for more specific advice in relation to any particular matter.

February 2007 - Enduring Powers of Attorney

Enduring Powers of Attorney are shortly to be replaced by Lasting Powers of Attorney although EPAs completed before the law changes will remain effective. There will be two types of LPA, those dealing with finance and property, similar to the present EPAs, and those dealing with health and personal welfare issues. LPAs  dealing with finance and property come with a number of disadvantages compared with EPAs.

  • Increased bureaucracy when the LPA is completed.

  • Much greater expense at the outset because of the requirement to register the LPA with the Office of the Public Guardian before it can be used.

  • This will add to the cost.

We are therefore recommending that our clients should create an EPA before the law changes. This will protect their finance and property position for the future. It will not prevent a health and personal welfare LPA being completed at a later date.
